GENERAL TERMS AND CONDITIONS

Our goal in creating the Color.Me.True app is to help people understand their own appearance, and how to enhance appearance through the use of the appropriate colors. In business and life, we believe in The Golden Rule: "One should treat others as one would like others to treat oneself."

If we had our druthers, there wouldn't need to be software Terms & Conditions at all.

That said, we also are firm believers that people should accept responsibility for their own actions, and Apple's App Store requires a EULA, so here are our General Terms and Conditions and EULA:

InfiniteBeauty.me, LLC and the app Color.Me.True are not responsible for the cost of clothes, handbags, shoes, accessories, purchased in or out of your color. Color.Me.True offers color advice and suggestions, but other color systems or color consultants may make other recommendations which may or may not match the color results of the Color.Me.True App. Translation: Every purchase you make is your own decision.If you don't like something, take it back or give it to charity or your cousin, but don't blame us.

InfiniteBeauty.me, LLC and the app Color.Me.True are not responsible or liable should you drop your iPhone, iPad or other tablet or mobile device while using this application. Translation: If you drop your device, and it breaks or the glass shatters, that really sucks, but don't blame us.

InfiniteBeauty.me, LLC and the app Color.Me.True are not responsible or liable should you injure yourself or others while using this application. Translation: If you break your toe with your device, that sucks even more, and you need to be more careful, but don't blame us.

InfiniteBeauty.me, LLC and the app Color.Me.True are not responsible or liable should your whole current wardrobe not be in your colors and you decide you must now go naked. Just kidding.

LIMITED SOFTWARE WARRANTY AND LICENSE AGREEMENT FOR END USERS

YOUR USE OF THE SOFTWARE IS SUBJECT TO THIS LIMITED SOFTWARE WARRANTY AND LICENSE AGREEMENT FOR END USERS AND THE TERMS SET FORTH BELOW ("AGREEMENT").

For purposes of this Agreement "Software" means all software programs made available by InfiniteBeauty.me, LLC and its affiliates, including the software application Color.Me.True, but not limited to mobile apps, downloadable/installable apps for personal computer and apps and services accessed by means of an internet browser.

BY OPENING THE SOFTWARE, INSTALLING, USING OR ACCESSING THE SOFTWARE AND ANY OTHER MATERIALS INCLUDED WITH THE SOFTWARE, YOU HEREBY ACCEPT THE TERMS OF THIS AGREEMENT.

1. LICENSE. Subject to this Agreement and its terms and conditions, InfiniteBeauty.me, LLC hereby grants you the non-exclusive, non-transferable, non-sublicensable, limited right and license to use one copy of the Software for your personal non-commercial use for use on a single computer or mobile device, unless otherwise specified in the Software documentation. Your rights are subject to your compliance with this Agreement. The term of your license under this Agreement shall commence on the date which you install or otherwise use the Software. Your license terminates immediately if you attempt to circumvent any technical protection measures used in connection with the Software. The Software is licensed to you and you hereby acknowledge that no title or ownership in the Software is being transferred or assigned and this Agreement should not be construed as a sale of any rights in the Software. All rights not specifically granted under this Agreement are reserved by InfiniteBeauty.me.

2. OWNERSHIP. Unless otherwise indicated, the Software and all content and other materials on the Software, including, without limitation, the Software logo and all designs, text, graphics, logos, icons, images, photographs, audio clips, video clips, digital downloads, computer codes, data compilations, software and the selection and arrangement thereof (collectively, the "Materials") are the property of InfiniteBeauty.me or its licensors or users and are protected by United States and international copyright laws.

   InfiniteBeauty.me grants you a limited, non-sublicensable license to access and make use of the Software, solely in accordance with, and subject to, the terms set forth here. Such license does not include: (a) any resale, commercial use, commercial exploitation, distribution, public performance or public display of the Software or any of the Materials; (b) modifying or otherwise making any derivative uses of the Software or the Materials, or any portion thereof; (c) use of data mining, robots or similar data gathering or extraction methods; (d) downloading or copying any portion of the Software for the purpose of posting on a file sharing network, the Materials or any information contained therein, (e) any use of the Software or the Materials other than for their intended purposes.

3. LICENSE CONDITIONS. You agree not to: (i) commercially exploit the Software; (ii) distribute, lease, license, sell, rent, lend, convey or otherwise transfer or assign the Software, any passwords or usernames or any copies of the Software, without the express prior written consent of InfiniteBeauty.me, LLC or as set forth in this Agreement; (iii) make a copy of the Software publicly available or available on a network for use or download by multiple users; (iv) reverse engineer, decompile, disassemble, translate, prepare derivative works based on or otherwise modify the Software, in whole or in part.

4. INFORMATION COLLECTION & USAGE. By installing, accessing or using the Software, you consent to information collection and usage terms, including (where applicable) the transfer of data outside of your country of residence.

   InfiniteBeauty.me, LLC respects your privacy rights and recognizes the importance of protecting any information collected about you. Our Privacy Policy is applicable to this Agreement and it defines how, why and to which extent we collect and use personal and non-personal information in relation our products and services. We will not sell your information.

5. LIABILITY IN NO EVENT WILL INFINITEBEAUTY.ME, LLC BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM POSSESSION, ACCESS, USE OR MALFUNCTION OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO, DAMAGES TO PROPERTY, LOSS OF GOODWILL, COMPUTER FAILURE OR MALFUNCTION AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURIES, PROPERTY DAMAGE, LOST PROFITS OR PUNITIVE DAMAGES FROM ANY CAUSES OF ACTION ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SOFTWARE, WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY OR OTHERWISE. IN NO EVENT SHALL INFINITEBEAUTY.ME, LLC'S LIABILITY FOR ALL DAMAGES (EXCEPT AS REQUIRED BY APPLICABLE LAW) EXCEED THE ACTUAL PRICE PAID BY YOU FOR USE OF THE SOFTWARE.

   BECAUSE SOME STATES/COUNTRIES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS AND/OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE ABOVE LIMITATIONS AND/OR EXCLUSION OR LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. THIS WARRANTY SHALL NOT BE APPLICABLE SOLELY TO THE EXTENT THAT ANY SPECIFIC PROVISION OF THIS WARRANTY IS PROHIBITED BY ANY FEDERAL, STATE, OR MUNICIPAL LAW, WHICH CANNOT BE PRE-EMPTED. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.
